Cannabis Delivery Services to be Discussed at Vista Council Meeting

Delivery Service License: A cannabis delivery service must obtain a City license before making
deliveries that originate or conclude in Vista. Licenses are issued only to applicants who possess valid
and current state retail licenses and, if located in Vista, who also are registered under Chapter
5.94. Measure Z businesses must demonstrate adequate parking to accommodate each delivery
vehicle used. Delivery service licenses terminate if the retailer loses its state license, or if a Vista-based business loses its registration under Chapter 5.94.
• Operatinq Requirements for Cannabis Delivery Services: Deliveries must occur between 9 a.m. and 10 p.m. using insured DMV registered, vehicles driven by licensed drivers. Deliveries are permitted only in a person-to-person transaction at a private residence, and in conformity with state law. Licensed delivery services must maintain insurance and indemnify the City against loses. Resulting revenues are subject to cannabis taxes imposed by Measure Z and the Chapter 7.10 of the Vista Municipal Code.
• Delivery Driver Work Permits: Delivery drivers for Measure Z businesses must obtain a Vista delivery driver work permit. Permits are available to persons who (1) are at least 21 years old; (2) have a driver’s license; and (3) have not been convicted of a felony, drug crime, or (in the last 7 years) a DUI.
• Inspection of Premises and Records: A Measure Z business, choosing to obtain a Cannabis Delivery License, must open its premises and records to inspection by Vista. In addition, extra-territorial delivery services must permit an audit of records by Vista for tax purposes.
