Class Action Law Suit by Charter Schools

Leaders from The Classical Academies, Springs Charter Schools and The Learning Choice Academy are joining a coalition challenging SB-98 and SB-820—California’s new state funding laws which do not provide funding for all growing public schools. Combined, the schools represented in the lawsuit have welcomed over 2,000 unfunded new students representing $20.9 million in withheld state funding. These schools represent a small portion of the 310 non-classroom based schools in California—many of which are growing this year. “With the Legislature and Governor aligned in their actions to bar any new funding to growing charter public schools offering independent study, we had to, in all good faith, stand up and call out behavior we believe to be unlawful.” Stated Cameron Curry, CEO for the Classical Academies.

The case was filed in Sacramento and will be heard by a judge in the coming months. It seeks class action status to include the 310 non-classroom-based charter schools in California that served 195,000 students last school year. Charter advocates say the state is penalizing these charter schools, because it is not giving them any additional funding to pay for these new students — forcing the charter schools to turn thousands of students away.
